1. General Terms

By accessing or using this mobile application ("App"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the App.

The App is operated by trafikX, based in Singapore ("we", "us", or "our").

2. Eligibility

You must be at least 13 years old, or the minimum legal age required in your country, to use the App.

By using the App, you confirm that you meet this requirement.

3. Scope and Purpose of the App

The App provides transportation, mobility, and location-based information and services, which may include:

• Traffic and travel conditions
• Public transport conditions
• User-submitted reports and images
• Forecasts, estimates, or analytics
• Promotions, vouchers, or offers from third-party merchants

All information is provided for general informational purposes only.

We do not guarantee accuracy, completeness, or timeliness of any information displayed.

You remain solely responsible for your travel decisions and personal safety.

4. User Conduct

You agree that you will:

• Use the App in compliance with all applicable laws and regulations of Singapore and Malaysia
• Not use the App for unlawful, harmful, misleading, or abusive purposes
• Not reverse engineer, decompile, or attempt to extract the source code of the App
• Not interfere with the App's systems, security, or data

5. User-Generated Content

5.1 Responsibility

You are solely responsible for all content you submit, including text, images, and comments.

By submitting content, you confirm that:

• You have the legal right to upload the content
• The content does not violate any laws or third-party rights

5.2 Prohibited Content

You must NOT upload or post content that includes:

• Photos taken at checkpoints, immigration facilities, or other restricted or sensitive locations
• Faces of identifiable individuals
• Vehicle registration or license plate numbers
• Harassment, defamation, threats, hate speech, or offensive material
• False or misleading reports intended to cause disruption or harm

The App is intended only for sharing transport and mobility-related conditions and observations.

5.3 Content Moderation

We reserve the right, but are not obligated, to:

• Remove or restrict any content at any time without notice
• Suspend or terminate accounts that violate these Terms
• Cooperate with law enforcement when legally required

5.4 Content Retention

User-submitted images are intended only for short-term traffic and travel relevance.

Images are automatically deleted during scheduled system cleanup cycles based on the age of the content, typically when they exceed approximately 30 minutes from the time of upload. Actual retention time may vary slightly depending on system processes and cleanup schedules.

Reports and comments may be retained for a limited period based on operational needs, relevance, and service improvements, and may be removed at any time at our discretion.

Temporary system backups or logs may exist for operational, security, or legal compliance purposes but are not used for public display or long-term storage.

We do not guarantee storage duration and do not provide recovery of deleted content.

6. Safety Disclaimer

You must not use the App in any manner that distracts you while driving or operating a vehicle.

You agree that:

• You will only interact with the App when it is safe to do so
• Reports should not be submitted while a vehicle is in motion

We are not responsible for any accidents, injuries, or damages arising from unsafe or improper use of the App.

7. Promotions, Vouchers, and Third-Party Offers

The App may display promotions, vouchers, discounts, or offers provided by third-party merchants.

We do not:

• Guarantee availability or fulfillment of any offer
• Control the quality, safety, or legality of goods or services provided by merchants

Any transaction, redemption, or dispute is solely between you and the merchant.

We are not responsible for losses or damages arising from third-party offers.

Additional terms may apply to specific promotions or voucher programs.

8. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App
• We are not responsible for decisions made based on App content, forecasts, or user-submitted reports
• If you have paid any fees to use the App, our total liability shall not exceed the amount paid by you in the preceding 12 months.
• If the App is free, our liability shall be limited to the maximum extent allowed by law.

9. Indemnification

You agree to indemnify and hold harmless the App, its operators, and partners from any claims, damages, losses, or expenses arising from:

• Your submitted content
• Your violation of these Terms
• Your violation of any law or third-party rights

10. Changes to Terms

We may update these Terms from time to time.

Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Singapore.

Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the Courts of Singapore.
